Customer Terms & Conditions
When you access this website and buy a new car through 90days.com.au the following terms and conditions will apply:
1. Age: You must be at least 18 years of age to buy a new car advertised on this website.
2. Payment: You must make a deposit payment of $500 when you buy a new car on this website. You agree to make this payment via a debit to your nominated credit card. The debited amount will be shown on our confirmation page prior to you clicking the 'Pay Now' button on that page.
3. Refunds: In the unlikely event that you pay a $500 deposit to buy a new car and that particular car has either been already sold or withdrawn from sale by the participating dealer, your $500 will be refunded to you within 48 hours. Similarly, if you are not able to obtain finance to complete the sale, your $500 will be refunded to you within 48 hours.
4. Closing: It is the responsibility of both the dealer and the buyer to close and complete the new car sales transaction. As 90days.com.au acts as a portal only, both parties need to make their own arrangements to facilitate final payment and delivery of the new car. A small transportation fee may be payable by the customer if the customer searches outside of their area and elects not to pick up the vehicle direct from the dealership.
5. Site Content: We make every effort to ensure all information displayed on our site is accurate; however, as considerable information is accessed from our participating dealers, we are unable to guarantee the accuracy of all information nor are we able to guarantee that the site is free from of errors or faults. We reserve the right to change information displayed on our site (including these terms and conditions) at any time without notice to you.
6. Liability: Without affecting any of your statutory rights that cannot lawfully be excluded, we will not be liable for any losses, damages, liability, claims or expenses (whatsoever and irrespective of whether direct, indirect, consequential) arising from the use of or connected with our website or any products or services purchased on our website. We make no warranty or representation as to fitness or suitability of any product or service displayed on our website. We are a portal for the sale of new cars from inventory supplied by each participating dealer and we do not over-sell that inventory (we cannot accept liability for the unavailability of new cars caused by a dealer over-selling its own inventory).

9. General: These terms and conditions are governed by the laws of Queensland, Australia. We receive commission payments from our dealer partners by accepting the $500 deposit paid by the purchaser directly to us which forms part of the total purchase price.
